NCAA appeal still in play

While Hawaii officials sounded down on the prospect of appealing the NCAA’s sanctions ruling against the UH basketball program last Tuesday, they did not rule it out entirely.

It turns out an appeal of the sanctions — a 2016-17 postseason ban, three years of probation and two docked scholarships for the next two years — is very much still a possibility.

Hawaii athletic director David Matlin said in a message UH has until Jan. 6 to decide whether to appeal, and that there has been “no final call yet.”

What do you think? Should UH appeal for the possibility of reducing the heavy handed penalties, at the cost of dragging out this process for many more months?

UH (9-2) takes on Mississippi Valley State (0-13) of the SWAC tonight at 7 at the Stan Sheriff Center.

Should point guard Roderick Bobbitt score 30 again, he will become the first UH player to do so in three straight games.

    Will it cost taxpayers more money? I think general public, getting tired of UH admin/counsel/ compliance dealings with Gib situation.

    Could have handled better? Surely, avoided a lot of problems.

    Drag out for How long?

    If UH could accept a POST SEASON BAN This season? And save for next season charge back to NCAA tournament for returning Jrs to be seniors.. I think that is an option too.

    Just get it over with? Too long already…

    With NCAA post season ban. Does that rule out possblity for pay for play tournaments.. I think there might be 3? CBI, CIT and another one?
    Know that NCAA runs Both the NCAA and NIT tournaments, so the ban would be for those tournaments only?

    Why are they even questioning if they should? Does it cost anything to appeal? Do they risk further penalties if they appeal? If the answer is no or attorney’s fees they should do it.

    We have a law school right there on the campus. Couldn’t we get this to be a project for some of the students? Have we checked to see if there is an attorney out there who is a BIG TIME supporter of UH and the Basketball Program that might be willing to represent the cause?

    The post season ban for next season is only a small part that will impact the program. We must remember that once a program is put on probation, the players are free to leave for another program without having to sit out. If the post season ban could be negotiated out of the penalties, then we may be able retain some of the current players from this season. Maybe the 3 year probation penalty could be brought down to one year too.

    Yes they should appeal. The post season ban next year should be the target of the appeal. If we have an exodus of our juniors it will will set a promising program back. We have already cleaned house (coaches, former AD).

    This is a “no-brainer”…We need to appeal…The NCAA has already acknowledged that there were no Level 1 violations and that the violations could have been mitigated if not for “internal squabbling” within the UH athletic program…One question we should ask the NCAA is whether they’d reduce the penalties if we got rid of the compliance officer who apparently escalated the problems that they cited. We cleaned house of all the offenders, but maybe, they think we didn’t completely get rid of the offenders.

    GO WARRIORS! Hey!. UH should get up from sitting on they’re butt and fright back!. Because they’re others larger Universities did same things like UH did or more. They only get a slap on the wrist!. Just like University of Kentucky and University of Louisville and lots more . It’s because of one thing? ( MONEY! ). and the NCAA won’t touch them!. Because they will lose big time money!. UH and Universities should file a law suit against the NCAA!. They might change there mind not pick on other small Universities like Hawaii. Because, I hate to see University of Hawaii goes to this and others don’t!. It’s a BS!. Because remember eight years ago it happen to University of Oklahoma football program? They only gotten a slap on the wrist!. They’re should be on probation for five years just like the University of Hawaii basketball program went through in the 70!. It’s really seriously come down is money! . Just fine a way to fright back!. Because got to stop! . But great news is the new head coach at UNLV said that? The University really needs of a new stadium. Because we Hawaiian who come to see our football plays at Sam Boyds Stadium. It’s really look like they are playing in a high school stadium!. Because Aloha Stadium looks 100% better then over here!.

Don’t like the fact that Amanda Paterson, was given a raise and promoted.. yet SHE WAS named as part of dysfunction, and tense atmosphere with Gib and his MBB program

    Be bold and highlight, investigate that aspect. I agree with Pocho. Amanda Paterson, how the hey, does she get off free and clear? Just like she had NO part in this mess. seems like UH is being punished more so as AN institution.. not only directed at Gib. the Admin .. is being punished.. Matlin can you explain that promotion of Amanda Paterson.. ? does not make sense.. she should be disciplined too,. then NCAA might , listen to UH appeal..

    Yes our university should appeal this decision. NCAA was too harsh for these violations. I wonder what kind of penalties North Carolina and other power 5 teams that are currently under investigation will receive.

    I don’t think Amanda Paterson is inept nor was she dysfunctional as UH Compliance officer, the NCAA did cite her poor working relationship with Coach Gib but I put the blame squarely on Gib’s shoulders as well as his assistant coach and player personnel director. UH has 21, 22 sports and the only work place issue last season and prior was with MBB – and that is coach Gib.

    Her job isn’t to protect UH against the NCAA by cheating or impeding any investigations, nor is she expected to look the other way when violations occur. For the greater good she has to protect the integrity of the UH athletic department and UH as an academic institution over any coach or sport that has crossed the line and violated NCAA by laws.

    The NCAA sanctions are for violations of specific by laws and not Amanda Paterson’s management style or her conflict with Gib. So the blame rest solely on Gib, as the head coach his program violated NCAA rules. nuff said as grandpa Al would say.

    The sad part of it all UNC Tarheels athletics will get a slap on the wrist. They will keep their wins and championship banners even though their athletes participated in 18 + years of enrolling in fake classes to remain eligible.

    From time to time, the ncaa will punish a power 5 school such as usc. But, overall they won’t take down the school’s with traditional basketball powers because they bring in the most money year after year. And, I would imagine they are bound to TV contracts.

    However, letting go Amanda Peterson is something that may help in their appeal process to the ncaa.

    UH should definitely file an appeal. The administration needs to show support for the players and the new coaching staff, who are being punished for transgressions they didn’t commit. Having said that, the university should look to its in-house legal staff to do the filing. Don’t spend a fortune on outside counsel to file it.

    2. poorboy … On page 25 of the Infractions Decision, it says the team “shall end it’s season with its last scheduled regular season game and be banned from post-season competition during the 2016-17 academic year.”
    So that means no post season tournaments including any play- for -pay ones and the Big West tournament too.

    As for UNC, their violations occurred before the new NCAA penalty structure was approved on Oct 30 , 2012 or went into effect on Aug 1, 2013, so they will probably get less severe penalties than if they were charged under the current penalty structure. That’s what happened for Syracuse who only got a one year post season ban plus vacating many victories and losing 2 scholarships for 4 years (after an appeal). They were charged with a Level I-Aggravated case, but the NCAA says most of their violations came before the new penalty structure was approved. UH was charged with a Level II-Aggravated case, but the NCAA says most of the violations came after the new penalty structure was approved.

    The unc tarheel program will go unpunished for their cheating. The ncaa will always delay punishment to a major program until they can find a way to minimize financial damage and still follow their own restructured rules.

    A major men’s basketball program in a power 5 conference is going to mess up again. The ncaa will again drag their feet in punishment. They will again draft a new penalty structure. And, the cycle will continue in the same manner.

    The major power 5 programs in men’s basketball will never be punished.

    The ncaa men’s basketball and march madness is big business. There is no way Emmert et al will let anything happen to their business model.

    My guess is the unc tarheel women’s basketball program will get hammered and the men’s basketball will be left untouched.

    Frank and Gib Arnold will forever be connected to UH basketball. After Frank Arnold left, I thought there is no way anyone will forget that name. Time heals all wounds. Then, Gib came along.

    The ncaa can be blamed for a lot of things. But, when it comes to mess ups with coaching hires, buyouts and blunders, the blame falls squarely on the leaders at UH.

    With all the mess ups at UH, you have to wonder, who is in charge at the school?

    Uh is always messing up. In house fighting, power struggles, and big egos within the UH system are all factors in all the screw ups. The screw ups will continue. I don’t buy into anything UH media relations say.

    UH wants more money for athletics? Why, so they can spend it on buyouts and attorney fees again?

She will never do anything that will help UH athletics when she could be the bigger person and do her job with the second highest coach within the department before.     BMc: I think UH should appeal. It will cost money, what legal action doesn’t. Is UH going to roll over every NCAA action? Like others have said the power conferences and teams challenge their NCAA allegations and get away with a slap on wrist penalty. UH has always been treated like the “ugly sister” by the NCAA and conferences. UH needs to turn this around and give it back to them. UH may be small compared to the power conferences but our vision should be Big.

    I don’t think anyone is questioning the fact that Gib is responsible for what he did. It’s the fact that Paterson did not do a good job in handling the personal situation between them. Per the NCAA, her quote of not (doing a good job) keeping track of the MBB program or not wanting to lift a finger to help them is not very professional.
    I also wonder why the AD and Chancellor were so quick to announce that they were not going to appeal. Is it because of the feedback that they are possibly changing their minds?

Manini type. and many the majority, the student loan , which my grand niece, she tells me for 10 years. she will be paying about $ 3000.00.. wow slaveitude for a Decade.. and my grand nephew paying $750.00 per month for 20 years. for finishing school in 5 1/2 years..So Hawaii people are paying a lot of monies into the budget of UH Manoa…do they have a say how Adminstration should be run..the

    Been talking to my grandchildredn, they love the softball world series run, Wahine FB, the excellence flagship of UH athletics, FB. don’t like concussions that hurt young atheletes for their entire lives..however Men’s Basketball.
    UH president, you don’t see him at Klum guy, or Paki Park, Kanawai field. Manoa Rec park.. running and winning games with Makule BB teams. first to 7.. and keep on running till you lose. Lassner IT geek…Bley Vroman, has to take his tounge/speech out of his arse.. just makes things worse.. Ben Jay,, and Bley Vroman’s clone of Ben Jay.. Dave Matlin..Matlin has mad a horrible decision

    Nobody is saying Gib did no wrong. The problem is if Amanda had problems with Gib the question has to be why didn’t she bring that up with the AD at the time? I’m led to believe either Amanda did not report the problem(s) with Gib/Staff/Team players or if she did she could have put the ONUS on the AD who was BenJay.

    Somethings Fishy with all the promotion of Amanda, UH must have questioned her, BenJay, etc. about the problems and yet UH promoted her. Is Amanda or UH Admin. hiding something from the public?

    It could be a Big story or maybe nothin if someone could look into this situation. UH doesn’t want to appeal could be saying something about not wanting to bring Amanda into the picture. IT SMELLS!

I saw/heard it on TV and it is bad! Last night I saw/heard it live…same opinion. I think she embarrassed both songs, I think Francis Scott Key and Queen Lilioukalani are turning in their graves.

    YES….APPEAL.

    The postseason ban is definitely arguable. Syracuse University got a one-year postseason ban (self-imposed last year) after inappropriate payments to basketball players, football players and assistant coaches over the course of several years. Athletes also received inappropriate academic assistance (basically allowed to cheat) and drug policies were not adhered to. SYRACUSE APPEALED and got their initial NCAA penalties REDUCED (scholarships were returned and money made from post season tournaments as well). Furthermore, the one-year basketball post season ban in 2015 was THE ONLY ban they got. They will suffer no bans in the future after all of this. These outcomes should help UH given that they have competent representation. The right thing to do is to fight.

    Question is for the legal experts, whether UH General counsel who did not present case very well, So this ruling knocked UH admin even harder, though level I allegations were knocked down to Level II, and some Level II down to Level III. and some were just dismissed completely.. Then that atomic bomb. that NEXT season post season ban.. only me? or does it sound like IN ADDITION TO SINCE YOU, although strongly hinted at Removing Amanda Paterson from the Athletic Compliance department, if not get her OUT of Athletics altogether, maybe the next Wahine Soccer coach? UH.. you did not listen to us.. so, you did not do what we strongly suggested, and for PUBLIC RECORD she came out as demonized.. You Promoted HER… son of a gun.. for that , UH.. we NCAA COI enforcement, we are going to kick your okole and give you the , and this where it REALLY hurts, recruiting coaching, fanbase for years to come..     YOU can just see NCAA COI. with billions at their disposal. getting ready for UH appealing hearings, and just knocking them back on their arses again and ADDING more investigation. perhaps even having UH apologize to Gib, and give him his job back.. IF they want Post Season next year. Gib as interim, Ganot as Associate for One year. then they part ways, Gib not angel, though NCAA his counsel was excellent, so we saw that agenda against him,he fought , and even had to misinform, he took sever hits, however is wife and family are so great, we give him a shot FOR ONE YEAR nest. to lead the team to NCAA’s. deal handshake between UH and Gib/ Bickerton, and done deal..

    That would be pono. then UH and Gib are friends again.. the Arnols come back to UH and Hawaii every Christmas time, spend 3 weeks in Kailua and cheer on the Warriors..
    sound like a fable. well no less absurd thatn UH challenging the NCAA. who are ready to knock them into the stone age.. The are just waiting, I know it.. Locked and Loaded.. and bissssh.. there goes UH / AD and Paterson. ..finally gone..

    Correct of Governor let UH to answer for their owm ineptness.
    Betterment of student athletes..
    Just look at past 8 years
    Things have as a whole gotten worse,
    Media and those buying spin…and administration not being pono..that is travesty
    Just ask men basketball families…they don’t like it, the dysfunction, that affected their sons..

    Unethical conduct by shady, cheating head coach hurts good people. Gib fans buying whatever comes out of his mouth or spin by his attorneys is a travesty. Players families can’t stand reading excuse after excuse from Gib apologists (that means people like Poorboy or Pono or whatevah name he using). Inexcusable and definitely not PONO. Btw, just saw news online that Poorboy has been selected as official spokesman for players’ families, friends, and people who barely know them. Straight scoop. Now Brian can just go to one source to get the REAL skinny.

    Read Poorboy’s comments (like you tell people to read report) and tell me he doesn’t want to get rid of everyone. It all begins and ends with Gib. No problems there and nothing to look into or investigate. But that doesn’t fit your reality. Whatever. Over and done. There are just as many people that are glad Gib is gone.     On the appeal UH should ask ncaa if Amanda P. was also given her walking papers would they have been more lenient on the penalties given to UH? AND did it matter regarding having Gib be shown the door and Fotu being suspended.

    What was the sense in letting Gib be fired without cause and Fotu being suspended based on the penalties levied. If they weren’t would UH have had 2 years of postseason band and 3 less scholarships to be given for the next 2 years.

    Imagine the team’s line up this year: Fotu, Jankovic, Bobbit, Valdez, Chan, Flemming, Smith, Thomas. A better chance to have gone to the big dance this year.

    Another blunder from those in charge. The what ifs are huge. The chancellor played is cards all wrong. A loser is his scheme of things.
